Terms and Conditions for the Use of FotoPlusWizard’s AI-Powered Copywriting Platform
These terms and conditions (“Terms”) govern the use of FotoPlusWizard’s AI-powered copywriting platform (“the Platform”). By using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.
- License and Use of the Platform
FotoPlusWizard grants you a limited, non-exclusive, non-transferable license to access and use the Platform for the purpose of generating copywriting. You may use the Platform only in accordance with these Terms and any applicable laws and regulations.
- Ownership of the Platform
The Platform, including all intellectual property rights therein, is owned by FotoPlusWizard. You acknowledge and agree that FotoPlusWizard retains all rights, title, and interest in and to the Platform, including all intellectual property rights.
- User Content
You may upload or enter certain information and content into the Platform in order to generate copywriting (“User Content”). You retain all rights in your User Content. By uploading or entering User Content into the Platform, you grant FotoPlusWizard a non-exclusive, worldwide, royalty-free license to use, modify, reproduce, and distribute your User Content solely for the purpose of providing the Platform to you.
- Prohibited Uses
You may not use the Platform in any manner that:
a. Infringes or violates the intellectual property rights or other rights of any third party;
b. Violates any applicable law or regulation;
c. Harms, threatens, or otherwise harasses any person;
d. Interferes with or disrupts the operation of the Platform or the servers or networks used to make the Platform available;
e. Attempts to gain unauthorized access to the Platform or any related systems or networks;
f. Uses any automated means, including robots, spiders, or scrapers, to access the Platform or collect data from the Platform;
g. Impersonates any person or entity, or falsely represents your affiliation with any person or entity.
- Fees and Payment
You may be required to pay fees to use certain features of the Platform. All fees are in the currency indicated on the Platform and are exclusive of any applicable taxes. You agree to pay all fees when due and to provide FotoPlusWizard with a valid payment method. If you dispute any charges, you must contact FotoPlusWizard within 30 days of the charge.
- Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND. FOTOPLUSWIZARD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- Limitation of Liability
IN NO EVENT SHALL FOTOPLUSWIZARD BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PLATFORM OR THESE TERMS, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, LOSS OF DATA, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION.
- Indemnification
You agree to indemnify, defend, and hold harmless FotoPlusWizard and its affiliates, officers, directors, employees, agents, and contractors from any and all claims, losses, damages, liabilities, and expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of the Platform, your User Content, or your breach of these Terms.
- Modification of Terms
FotoPlusWizard may modify these Terms at any time, in its sole discretion. If we modify these Terms, we will post the modified Terms on the Platform. Your continued use of the Platform after the posting of the modified Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Platform.
- Termination
FotoPlusWizard may terminate your access to the Platform at any time, for any reason or no reason, without notice or liability to you. Upon termination, you must immediately cease all use of the Platform.
- Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
- Entire Agreement
These Terms constitute the entire agreement between you and FotoPlusWizard with respect to the Platform and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and FotoPlusWizard.
